First, the backstory:

The Houston father who police say fatally shot a 17-year-old boy who was inside his daughter’s bedroom early Thursday morning will likely not be charged, an area prosecutor told MyFoxHouston.com.

Although a grand jury will review the case, prosecutor Warren Diepraam said it is unlikely that the father will be charged.

“What was going on in the person’s mind at the time of the shooting, [not] what they found out after the fact” is key, Diepraam said. “They’re looking at what he was thinking when he made the decision to shoot.”

The investigation into the shooting is ongoing, and a grand jury will ultimately decide if charges are appropriate. But so far it appears the father, who was only identified as a 55-year-old in reports, was awaken by one of his other children at about 2:20 a.m. He was told someone was in his 16-year-old daughter’s bedroom and he grabbed his gun.

He reportedly found the teen in bed with his daughter and confronted him. His daughter apparently told him she did not know the boy.

The father said he told the teen not to move, but reportedly saw the teen reach for something, at which point police say the father opened fire. The teen did not have a gun. His daughter later confessed that she snuck her boyfriend, 17, into the house, the report said.


I want you all to pause for a moment and think about that story. I don’t know about you but I think it was a tragic accident, but without some other evidence of wrongful intent I see no reason to charge the father with anything.

I first saw this story at Fox Nation yesterday. It was on the front page at a time when not much was being reported about the shooter, his daughter, and the dead teenager. Now we know that all three are black. The story’s no longer on the Fox Nation front page.

Still, for a while, it clearly embodied the right-wing perspective on the proper conduct of society — if you find a boy in bed with your daughter, of course you should be able to take your gun and kill him.

The race of the people involved makes the story, for the Fox audience, a lot less relatable — but I’m not surprised that the authorities are going to let the shooter walk in this case, even if he is black.

The salient point here is that the shooter still outranks the victim — he’s a black man, but his victim is a black teenage boy, which makes him the lowest form of life as far as most of America is concerned. We know that George Zimmerman walked because, as an adult male Hispanic with fairly light skin and a European surname (and an avid interest in “law and order”), he vastly outranked the black teenage boy he shot. By contrast, we know that it’s considered justice to sentence Marissa Alexander to twenty years, and perhaps resentence her to sixty years, because she’s a black female, and the abusive husband at whom she fired a warning shot is a black male — yes, black men are very low in the hierarchy, but they still outrank black women, because males outrank females when we’re talking about sex and violence.

The principle that murder is justified if a father finds his daughter in bed with her boyfriend would not, obviously, have been extended in the Houston case if the boyfriend were white. But since that wasn’t the case, the principle still applies. These are just simple, commonsense values we’re talking about, right? Even if an unarmed boy who was just doing what teenagers do is now dead?


So Fox runs the story on Friday, but by Saturday it had fallen off their front page as new stories were published, and that’s evidence of racism? I’ll skip over the gratuitous cheap shots at right-wing morality and George Zimmerman and focus on the real issue:

What the fuck does race have to do with this story?

Seriously, what kind of sick, perverted mind finds a racial grievance angle in a tragedy like this one?

Would racial justice be done if the father was charged with murder?

What the fuck is wrong with these people?

    When I first heard the story, skin color never entered my mind, just a horrible, tragic story.

    Speaking of tragedies, haven’t heard a peep about that Texas honor killing of a gay daughter and girlfriend since Helen posted about it. No outrage from the LGBT? Maybe if the dad were a white Christian?

    I am utterly amazed at the number of people who want to lay all the blame on the daughter in this scenario. Let’s be very clear: yes, what she did is immoral. But she didn’t pull the trigger. She didn’t kill him. The father did. Nor should we be terribly surprised that the daughter of the sort of violent man who would straight up murder this kid would be too afraid to tell him the truth about her sex life. I imagine the truth wouldn’t have gone down well with Daddy.

    Yes, the daughter panicked. But she wasn’t carrying a gun. Daddy panicked too, but since he was carrying a gun an innocent kid is now dead.

    A lot of people out there harbor fantasies about killing “evildoers.” A lot of guys out there want to be able to murder their daughter’s rapist and have society sanction that. Even had she been telling the truth, the father and his gun don’t get to serve as judge, jury and executioner. Daddy and his gun are not a court of law. The daughter wasn’t on the stand to perjure herself, and she committed no crime. Had the father shown an ounce of self-restraint and called the police, the situation would have resolved itself quickly and she would have recanted her lie. Daddy, his temper and his gun cut justice short.

    It also highlights everything wrong with Castle Doctrine and Stand Your Ground. This kid was unarmed and posed no threat to anyone. The father says that he felt threatened and saw the kid “reach for something.” Well, unfortunately this innocent young man is dead now, so we’ll never know if he did make a sudden move or not. He’s not around anymore to tell his side of the story. Insanely, the burden of proof is now on the state to demonstrate that violent men with guns didn’t “feel threatened” by something or other. In the vast majority of cases, the only violent threat in a room with an armed man is the armed man himself.

      This is a good comment on the blog you linked to, makes sense to me…..

      I dunno. The teen was an unknown intruder, from the father’s perspective. One news source reports that the father first called 911 while holding the teen at gunpoint, and then the shooting occurred. That sounds like a timeline where the teen did *something* that the father perceived as a physical threat. While tragic this may be a fair application of the castle doctrine.
      I’m reminded of a story from a few years ago, when a father witnessed his daughter being raped in her own bed and quietly left the room, because he mistook the rapist for her boyfriend and she was too terrified to call for help.

        I kept seeing video of the voting and they had these clear boxes where it appeared the ballots were placed. Nobody explained those boxes, but there were 3. I wondered if they were, yes….no…..maybe or something. If you had to put your ballot in a specific box and there were armed guards that doesn’t sound like a very fair election.

    The boyfriend was supposed to be in New Orleans for spring break per his mother. He is seventeen and she had no idea what city or even state he was in but she claimed he would never do anything wrong like sneaking into another man’s house to boink his 16 year old daughter. The local paper described the boyfriend as acting aggressively towards the father after his girlfriend told her father (with a gun) that she didn’t know who the guy was. I’m not sure what this guy was supposed to do. At that moment he is seeing a guy he doesn’t know in the sack with his 16 year old daughter in the middle of the night in HIS house, she tells him she doesn’t know this guy thus implying rape, the unknown guy (who is really the boyfriend) acts aggressively (per the Houston newspaper) towards dad so the dad shoots the dude with his own safety, his other children’s safety, with an unknown rapist in HIS house. I’m sorry but this girl set this up by denying she knew the boyfriend who then acted a fool getting aggressive in another man’s house. This will be a no bill from the grand jury. And race has not one damn thing to do with it. Implying that this man had a duty to provide a comfy place for his daughter to have sex with some asshole with no questions asked is what the victim designators are implying. No. This dead dude is not a victim but a opportunist who got caught and grossly disrespected this man. Dad is not required to provide sex partners for idiots.

      Both of my sons attempted to (on at least one occasion each) to sneak into a girl’s home in the night to have consensual sex. At least one of them was successful. (I caught one going out and the other coming back in) I warned both of them of the possible dangers, including getting shot by the girls’ fathers.

      OTOH, I lost my virginity by sneaking in the same way.

      I don’t want to blame “society” for this as an easy out, but this kid seemed to think it was okay to have sex in a girl’s home with her parents there. They used to make teenagers get married for that.

      I also wonder if this was in a relatively safe or unsafe neighborhood. With Houston, it could go either way. If you are doing something wrong, the chances that something bad will happen to you will go up.

    I would have shot too.The daughter should be charged. It was her actions that led to the tragedy. A few years ago a guy was crawling through my doggie door at three am. Ihave a brick on the dryer for balance. Brought it down pretty hard on his head. State police showed up a few hours later. Guy claimed I assaulted him. Really surprised I didn’t kill him. What are you supposed to do let them enter ascertain their objective draw a flow chart of possible outcomes and after a discussion with the intruder then react. Jebus on a taco. When my wee one was still in diapers we were at the zoo and this subhuman guy was watching me change her on the table. He had this look on his face . Thank god there were others there cause I went after him. Thirtysomething guy hanging out in the changing room at the zoo by himself to get a peek at kids. Had I been allowed to do what I wanted I would not have a shred of remorse. A stranger in your daughter’s bedroom in the middle of the night. I applaud the guy. Reminds me of the woman in Texas with the new born guys were breaking down her front door and e 911 operator told her to do what she had to do to protect herself and her baby. Blew the miserable fuck off the face of the planet.

      Damn straight, mothy! So far as the dad knew this was some strange man raping his daughter at 2 in the morning! And the dad STILL didn’t shoot until the dumbass refused the dad’s order to stay still, and made a move. I think the dad showed remarkable restraint to have not shot him sooner.

      Wow, I did not need to read THIS right now. My oldest son is rocking a 1.75 GPA in the LA PUBLIC SCHOOLS–to give you an idea of the quality education he is receiving, when I emailed his English teacher, I received a response that was riddled with spelling and grammatical errors. So I’mma gonna have to home school him this summer (for catch-up) to those damn CC standards. Ugh ugh ugh.

    How does one find a good attorney? I loathe the sue culture but I they are forcing my hand. I was hours away from death in August and I repeatedly told my docs something was not right with my meds. I had a severe rash because my kidneys and liver had shut down and my skin was compensating. Went to a local small hopital fot the rash. They were very kind asked if I wanted to talk to a priest or minister.Knew my number was up but 13 days later my blood work was normal except for my INR and that was only .1 over. I was happy to just not be dead. Confess a tiny bit disappointed. You get yourself already for it and then they say oops just kidding you are still gonna live. Isent my doctor everything and he never called me back. Not one time following an acute episode. Let the river run was my stance. 7 months later I get calls and letters everyday from patient specialists. I do not want to talk to anyone until I consult with a pro. I have tremendous respect for medical professionals but enough is enough. They told me at one point I had full blown Hep C I knew they were wrong. Not once have I had unprotected sex or used a needle. I do not have it. They put me through hell. Told me over and over again I was near death. The drugs got so bad at one point I took my bossy brat miniature golfing and I could not make it back to the car. Kept telling myself just make it to the next parking space. With little short goals I was able to walk across a parking lot and my urchin was none the wiser. I hate law suit stuff and if they had left me alone I never would have acted but my god

        I’m all for protests etc where real exclusion exists. But the activist gay left, anymore, is starting to wear on my nerves like that one person you know who makes everything, and every single conversation, all about them. It’s not that you mind them talking about themselves. It’s just that after awhile, you realize they are incapable of not seeing every topic on earth only and ever in terms of themselves.

          AMEN. I have been gifted a very unique life and I am grateful. Kid with an outhouse high school drop out parents and a very fucked up ticker made it to NYC, LA London Paris and Prague. Not going to be able to leave my bossy brat what I,’d like but pray that I leave her with the knowledge of my mistakes. I got very lucky there too. She turned me into the incredible hulk. She was a throw away. First time I met her she was in a playpen lined up against a wall with seven otherd. Pretty sure I turned green and ripped my clothes off. No fucking way.
          When I follow the gay stream it always makes me sad. It can be excruciatingly hard but pick your battles and know you have a responsibility as a thinking person to be someone.

Used the youtube app on the tv to watch the official video when it was over the next played Vivaldi then a sort of hip hop rap thing, Idina Menzel and this voice over guy singing let it go in different characters.     I was not well this weekend, so lay around and watched ALL of DaVinci’s Demons on Netflix. Really good stuff, but then I love Florence and Rome and artistic flawed genius bad boys, and papal intrigues and secret societies. The new season starts Sunday, so I’m all caught up now.

      Was up til 3 Saturday night watching “House of Cards”. Gonna watch ” Jig” after work tonight . Between Netflix and Amazon instant vids, I don’t watch tv much. Well there’s March Madness now. Bought a bigger screen tv Saturday, so movies are even more fun to watch.
