Acquittal of Bundys is proof of racial double standards — and a greenlight for right-wing terrorism

When the Raw Story visited the Bundy bunch inside the Malheur National Wildlife Refuge they were calling for a revolution against the federal government. Rifle-toting supporters said, “ I’m here to fight for freedom and get our Constitution back,” and “I would support this to the death, literally.”

Now eight months after their occupation came to an end the government case has ended in a jury acquitting the two Bundy brothers and five other supporters on all charges but one, including the main one of conspiracy. The government failed to prove the Bundy Bunch “had engaged in an illegal conspiracy that kept federal workers — employees of the Fish and Wildlife Service and the Bureau of Land Management — from doing their jobs.”

The jury’s logic is not known yet, but it is a double standard that almost certainly turns on race. If a group of heavily armed Muslim Americans or Black Lives Matter activists seized public facilities and land, the government would have rushed in with all guns blazing and anyone who survived would be locked up for life. The record of post-9/11 terror prosecutions is littered with hundreds of cases of entrapment, paid informants, and “fake terror plots.”

For more than a decade the feds have also prosecuted similarly flimsy cases against environmental, animal-rights, and Occupy Wall Street activists, known as the “Green Scare.” Numerous peaceful activists have been sentenced to prison for more than a decade for little more than conversations egged on by paid FBI provocateurs. Even in cases where violence was planned, no one was ever injured and it was often completely instigated and organized by the government.

But when it comes to the Bundys, they actively planned the illegal armed takeover. At least two months before the refuge occupation began Jan. 2, 2016, the Bundys visited local sheriff Dave Ward and warned him to prevent two local ranchers convicted of arson from going to federal prison. According to Ward, the Bundys said they would “bring hundreds of people to town [and] attempt to overpower or overthrow my authority as sheriff.”

Inside Malheur, in a two-hour conversation with Ammon Bundy in his pickup truck, when this reporter pointed out their intent was to spark a violent uprising against the government, he did not deny it. Militia members openly carried weapons on federal land, which is illegal, and the Raw Story witnessed the militia stealing and damaging government equipment, violating the law in tearing up sensitive archeological sites, and building barricades and bunkers for an apocalyptic showdown. The Bundys also set up a kangaroo court to indict, try, convict, and remove government officials from office.

Yet according to the jury the government did not prove a conspiracy. Meanwhile, halfway across the country in North Dakota, a huge force of police and private security are viciously attacking Native Americans peacefully protecting their land from the ravages of the oil and gas industry.

The Bundy case is more proof of the well-documented racial bias embedded in the jury system. The notion that an armed militia with snipers stationed in the watchtower, blockading all road into the refuge and vowing to die for their cause did not impede federal workers from doing their job is as absurd as it sounds and is an indictment of the deep racial biases in America.

The silver lining is the Bundy brothers and their father still face trial for their violent confrontation in Nevada with government officials in 2014 over their refusal to pay $1 million in overdue grazing fees on federal lands.

The Bundy acquittal will embolden violent right-wing militias to seize other public lands, especially West of the Rockies where there is a movement funded by the Koch Brothers to undermine federal control of huge swaths of land.

Undoubtedly these violent militias will be aided and abetted by legions of Trump’s supporters calling for a “violent revolution” if Clinton wins the presidency as expected. The government’s hands-off approach toward the militia movement is a failure. This isn’t a call for more repression as used against Muslims, African-Americans, and left-wing activists. It’s a demand the government protect the public and its lands from the growing threat of right-wing terrorism.

I’m guessing that the acquittals have something to do with the numerous (15) undercover informants that were actively involved in the stand-off. So far I have only seen one news story that even mentions those informants.

    I know this sounds crazy but I tend to believe that juries get it right more often than not.

      I agree — and, like most attorneys, we have more familiarity with jury verdicts across the board than the non-attorneys/lay persons who only hear about the sensational cases in the news.

      Now they don’t seem to want to do the shooting themselves, but some name less some bodies should. And ironically enough, the post ius tagged gun nuts.

They put out some BS statement framed as a question and when you sit there with your mouth hanging open stunned that anyone would even think such a thing let alone say it, they conclude you are a crazed Republican because you didn’t give the required secret response.

    The prog press is a riot. They’re talking about Trump supporters as if they’re terrorists and what will they do if Trump loses. Very good question, but they tend to be more like he tea party crowd who didn’t resort to violence even after they were basically destroyed by the IRS and the GOPe. They, we, certainly are getting tired of the corruption and cheating, and the continued oppression from the IRS, the press, and the elite. But I think it would take bigger moves against the 2A and continued erosion of the 1A before anyone would do anything bold. The real question is, what would Hillary supporters do if Hillary loses. I think they would riot and there would be massive violence. Just look at a typical BLM or older OWS activities for an example.

      I disagree with a snowflake rebellion. OWS and BLM were given carte blanche by administration. The architects of faux movements knew it coordinated to bring it with govt. Protesters were often paid. The collusion has been exposed.
      There was a great video of a protest in Pittsburgh where this teeny tiny metrosexual was screaming at Trump supporters big guy took a step forward and precious shrank. I bet we’ll see some reaction before inauguration but not much.

      If Trump were to win by a landslide, maybe small reaction to the results. If he were to win, but by a small percentage point, I could see Soros paying for massive protests. I just don’t see he and his crowd giving up and walking away. Not after what they have put into it these many years.

      I like to think if Trump wins, Europeans would get some courage to do something about there situation. But then again, I think so many of those countries are lost already.

And now he is looking at the EU banking system going tits up and losing money for him. Soros seems to have gotten a little ahead of himself I suspect because he wants to SEE the flip to anarchy before he croaks.         I’m reading they are seeing record early voting turnouts and its people who aren’t registered R & D, but those who haven’t voted in many years or ever. Wife had NBC news on last night (GAHHHHH) and they said huge early voting – I found it significant that they didn’t say it was mostly African American.

          When we voted early we had to wait in line an hour, it was 100% white people with two nice looking Latino women in line with a few adorable children. While mostly middle aged or older there were a lot of younger men with gimme caps on who came from work alone. The ratio was about 60-65% men which is unusual here because women vote always in every election even the bond issues. Everyone voted fast which means straight ticket and Republican. There were 80 voting machines because I asked them how many and it seemed very busy. They said it had been that way since Monday when they opened. It is a YUGE turnout in Texas.

          In Meryland, more people voted on the first day of early voting , than had voted in the entire period of early voting in the 2012 election. No report of demographics of voters, that I saw, but for a deep blue state, I thought that was interesting.

            Washington State doesn’t have polling places, we have been all mail in for 10 years. Now they have ballot drop boxes because people got so mad about having to pay for a stamp. I’ve marked my ballot but I’m not turning it in until a day or two before election day because I don’t want to give them a heads up on how many fake votes they need to come up with.

    Gosh — Polls “unexpectedly” tighten now that the actual elections results will be known & pollsters need to worry about credibility instead of setting narrative.
    If previous polls were “right” — Hillary lost 8 points in one week.

I suspect the same for the media companies and the prospect of a Trumpian banishment, Trumpian de-regulation, and Trumpian Youtube or WH video announcements instead of press conferences is a bit daunting. I noticed the WSJ seems to be changing their tune in the past few days. I have chosen the -ian as in Olympian rather than my ususual -ite (Hill-ite, Obama-ite, Jeb-ite) because it sounds better and more dignified.

There is a stronger movement this time to vote against the Democrat machine than any time I can remember. The television/radio commercials are many and frequent. (Of course, this is the first time in 40+ years that I’m not at work during the day and I can see/hear the amount of election ads. It is astounding.)
      I hope irregularities are reported. But here, I’m not sure it will mean anything. 😦
