      I’m happy about this victory but FFS, it’s depressing and discouraging that you have to get to an APPELLATE court just to get permission for a candidate’s observers to WATCH the counting.

        I know. It is more disturbing because of the time that has passed. The creation of dead people voting doesn’t happen there, it happens in the counties. I’m not sure what standing 6′ away from someone will show anyone.

          I know approximately zero about election law, federal or otherwise, but my law partner and I were just batting around the question of what is the remedy in this kind of situation? You can’t re-do a national election. Unless you’re a state like Vermont, you really can’t re-do it on the state level either. I suspect it might be too late to disqualify individual ballots if this malfeasance is as widespread as we think it is.

            I know nothing about election law. I do know a little bit about how a major international company stops something that’s bad from continuing to happen. Non-disclosure agreements keep me from saying who, where, why, or when. But based on how a company can do it, I’d say the first step is to halt all counting, empty the rooms of people where it’s happening and anywhere ballots are stored. Secure the rooms and post security at all entrances and exits and set up video surveillance. Remove all computers from the network. That at least freezes the “bad” from continuing to happen. Next step is to identify breakpoints. If we were going to try to go back in time to a previous step, where can we pick? Can we identify any ballots received after midnight on election day and isolate them, or have they been assimilated into the rest of the ballots? Can we isolate the “naked ballots” at this point? Can we set aside all of the ballots that have only been marked for the presidential race? I’m not suggesting all of these ballots be discarded, but if we can’t identify different groups of ballots, a court ruling against counting them is meaningless.

            If the election is declared too tainted to have yielded a trusted result, what legal steps would it take to make the election as a whole null and void? What about voiding the election in just the disputed states? We have the Electoral College vote coming in a few weeks. Since elections are controlled at the state level, could a state legislature choose the state’s electors, given a null election? Barring that, the House of Representatives needs to certify the vote in January. It’s not a vote of the full House. Each state gets one vote. There are places between here and January 20th where there are processes that give us safety valves. The only question is how to use them.

            I don’t see why we can’t redo an election. We sent men to the moon and brought them back. If you mean it wouldn’t be legal, well cluster fucking the election on purpose isn’t legal either and that didn’t stop them from carrying it out.

            em, that should have happened yesterday. I don’t think Trump’s campaign could do it, it would have to be DOJ, no? Where are they in all of this mess? Also, Larry Schweikart thinks MI, PA, and WI should name electors for Trump due to the apparent massive fraud in counting votes. But he knows that they would never do it.

            This is the problem, along with certain assumptions judges and justices have to make about the motives of political actors. Convincing them of election-stealing with that deference in place is a losing proposition. This is a clusterfuck, and I will wait for the results after Trump fights, but I don’t see a way out of this chaos Democrats have deliberately sown here. I will never forgive Dems for it, and I may never forgive the GOP for their failures either.

            The president is elected by the Electoral College. Electors are chosen by the states. The method by which they are chosen is actually largely up to the states. For example, the NPVIC (popular vote compact) practically says “we don’t care what the majority our state wants, the national vote decides. The only restrictions I know of are Civil Rights law, but that’s more of a lawyer issue.

            Theoretically, the governor could just pick the electors if the state constitution was written that way. Back in 2000, the Democrats suggested that Florida sent 2 slates of electors. Of course, that would have handed Gore the presidency.

      See, I have been thinking this since election night. Someone suggested that they need to stay silent while Trump fights this, but that is bs. This is a matter of getting the public on Trump’s side while his campaign fights the fraud. I hate the GOP, he is a big (maybe only) reason they get elected and then the SOBs can’t even stand up for him. Why, it’s almost if they want him to lose. And if we have a President Biden, then I am sure they will all go back to their old ways of voting for whatever the Dems want. And while we are at it, I am not putting a lot of faith in the Supreme Court once this ends up there. Including Amy. As much as I like her, I had the distinct impression that she will recuse herself if election issues make their way to the Supreme Court. Hope I am wrong.

      (I checked quite a few Rs on twitter, couldn’t find any speaking out for Trump.)

    I am watching Newsmax (which I really like). Reporter said she asked DOJ why they haven’t gone in to investigate fraud, they said their is a law that they have to wait 10 days. She talked to higher level officials, they gave her the same bs but couldn’t say where to find such “law”. Also, she confirmed that Mitch has indeed been talking favorably to Biden or his people about working together.         One of the history lessons these guys haven’t learned is the one where when you don’t stand up for people, there will be no one there to stand up for you. Trump suporters kept Mitch McConnell in his seat, Lindsay Graham in his. They kept Texas red for guys like Crenshaw. If Trump goes down because prominent Republicans kept silent, there will be no reason for Trump’s supporters to send money to ‘LindsayGrahamdotcom’ next time. Maybe he thinks we’ll forget in 6 years, but I wouldn’t bank on it.
